Cab Grill, her\u00adein\u00adaf\u00adter refer\u00adred to as the Contractor, ful\u00adfills all orders on the basis of the fol\u00adlo\u00adwing General Terms and Conditions, which app\u00adly to all pas\u00adsen\u00adger trans\u00adport and cou\u00adrier ser\u00advices within Austria and neigh\u00adbor\u00ading count\u00adries. Deviating terms and con\u00addi\u00adti\u00adons of the cus\u00adto\u00admer, her\u00adein\u00adaf\u00adter refer\u00adred to as the cli\u00adent, shall not app\u00adly, even if the con\u00adtrac\u00adtor does not express\u00adly object to them. Deviations from the GTC requi\u00adre the express writ\u00adten accep\u00adtance of the con\u00adtrac\u00adtor. By pla\u00adcing an order, the Client ack\u00adnow\u00adled\u00adges and agrees to the fol\u00adlo\u00adwing GTC. Finally, a con\u00adtract is only con\u00adcluded if the order is con\u00adfirm\u00aded by the con\u00adtrac\u00adtor. <\/p>\n\n
The ser\u00advice con\u00adtract shall be con\u00adcluded exclu\u00adsi\u00adve\u00adly bet\u00adween the Client and the Contractor. Any form of amend\u00adment or addi\u00adti\u00adon to the order pla\u00adced must be noti\u00adfied to and agreed with the con\u00adtrac\u00adtor. The per\u00adforming driver\/subcontractor is not aut\u00adho\u00adri\u00adzed to deci\u00adde on con\u00adtrac\u00adtu\u00adal chan\u00adges for the con\u00adtrac\u00adtor. <\/p>\n\n
The Contractor under\u00adta\u00adkes to per\u00adform the agreed ser\u00advice to the best of its know\u00adledge and belief. It shall only be lia\u00adble to the Customer for dama\u00adges in the event of intent, gross negli\u00adgence or cul\u00adpa\u00adble breach of mate\u00adri\u00adal con\u00adtrac\u00adtu\u00adal obli\u00adga\u00adti\u00adons. In the event of inju\u00adry to life, limb or health, lia\u00adbi\u00adli\u00adty shall be gover\u00adned by the appli\u00adca\u00adble laws. All vehic\u00adles are cover\u00aded by lia\u00adbi\u00adli\u00adty insu\u00adrance in accordance with the appli\u00adca\u00adble General Terms and Conditions of Insurance; the cli\u00adent is respon\u00adsi\u00adble for any addi\u00adtio\u00adnal insu\u00adrance that may be requi\u00adred.
The con\u00adtrac\u00adtor is not lia\u00adble for missed dead\u00adlines and their eco\u00adno\u00admic con\u00adse\u00adquen\u00adces, unless the\u00adse were cau\u00adsed by the con\u00adtrac\u00adtor; this includes, for exam\u00adp\u00adle, delays cau\u00adsed by traf\u00adfic jams, road clo\u00adsures, vehic\u00adle break\u00addowns, traf\u00adfic acci\u00addents or poor wea\u00adther con\u00addi\u00adti\u00adons. <\/p>\n\n
The cli\u00adent is obli\u00adged to com\u00adply with the curr\u00adent\u00adly valid StVO. The respon\u00adsi\u00adbi\u00adli\u00adty for the safe trans\u00adpor\u00adta\u00adti\u00adon of child\u00adren and young peo\u00adp\u00adle under the age of 18 lies enti\u00adre\u00adly with the cli\u00adent or the legal guar\u00addi\u00adan. In addi\u00adti\u00adon, the Client under\u00adta\u00adkes, also on behalf of its pas\u00adsen\u00adgers, not to misu\u00adse the ser\u00advice pro\u00advi\u00added by the Contractor, not to obs\u00adtruct the per\u00adfor\u00admance of the ser\u00advice, not to vio\u00adla\u00adte cri\u00admi\u00adnal law, not to cau\u00adse any dama\u00adge, to com\u00adply with the smo\u00adking ban in the vehic\u00adle and not to refu\u00adse to accept pay\u00adment.
In the event of a vio\u00adla\u00adti\u00adon by the Client, the Contractor is entit\u00adled to take the neces\u00adsa\u00adry mea\u00adsu\u00adres. In the case of cou\u00adrier trips, the cli\u00adent must ensu\u00adre that the trans\u00adpor\u00adted goods are secu\u00adre\u00adly and pro\u00adper\u00adly packa\u00adged for trans\u00adpor\u00adta\u00adti\u00adon. Otherwise, he shall be lia\u00adble for any kind of dama\u00adge cau\u00adsed during trans\u00adpor\u00adta\u00adti\u00adon, irre\u00adspec\u00adti\u00adve of any fault on the part of the con\u00adtrac\u00adtor or the driver\/subcontractor car\u00adry\u00ading out the trans\u00adport. <\/p>\n\n
When pla\u00adcing the order, the Client under\u00adta\u00adkes to pro\u00advi\u00adde the Contractor with pre\u00adcise and com\u00adple\u00adte infor\u00adma\u00adti\u00adon about the boo\u00adked jour\u00adney. This includes the neces\u00adsa\u00adry infor\u00adma\u00adti\u00adon on pas\u00adsen\u00adgers, time and place of ser\u00advice pro\u00advi\u00adsi\u00adon, as well as any trans\u00adpor\u00adta\u00adti\u00adon goods. In the event of incor\u00adrect or incom\u00adple\u00adte order infor\u00adma\u00adti\u00adon by the cli\u00adent, the con\u00adtrac\u00adtor accepts no lia\u00adbi\u00adli\u00adty for any resul\u00adting dama\u00adges. Any chan\u00adge to the agreed pick-up time must be com\u00admu\u00adni\u00adca\u00adted to the Contractor imme\u00addia\u00adte\u00adly; any dama\u00adge resul\u00adting from fail\u00adure to noti\u00adfy the Contractor imme\u00addia\u00adte\u00adly shall be bor\u00adne by the Client.
In addi\u00adti\u00adon, the Client is obli\u00adged to inform the Contractor of any dan\u00adge\u00adrous or peri\u00ads\u00adha\u00adble goods to be trans\u00adpor\u00adted, as well as the trans\u00adpor\u00adta\u00adti\u00adon of ani\u00admals and valu\u00adables or money (inclu\u00adding the exact value or amount). Should the cli\u00adent fail to com\u00adply with his obli\u00adga\u00adti\u00adon, he shall be lia\u00adble to the con\u00adtrac\u00adtor for all cos\u00adts or dama\u00adges incur\u00adred as a result.
The con\u00adtrac\u00adtor is entit\u00adled to imme\u00addia\u00adte\u00adly unload and store all goods about which he was not infor\u00admed when the order was pla\u00adced, at the expen\u00adse and risk of the cli\u00adent. If the trans\u00adpor\u00adta\u00adti\u00adon can\u00adnot be car\u00adri\u00aded out due to incom\u00adple\u00adte or incor\u00adrect infor\u00adma\u00adti\u00adon, it may be refu\u00adsed by the Contractor, the driver\/subcontractor car\u00adry\u00ading out the trans\u00adpor\u00adta\u00adti\u00adon, and the cla\u00adim for pay\u00adment shall remain in force. If neces\u00adsa\u00adry, the Contractor shall be entit\u00adled to adjust the pri\u00adce on site to the new cir\u00adcum\u00ads\u00adtances. <\/p>\n\n
In prin\u00adci\u00adple, the cli\u00adent is char\u00adged \u20ac 40 per hour for wai\u00adting times, wher\u00adeby a distinc\u00adtion is made bet\u00adween nor\u00admal jour\u00adneys and air\u00adport pick-ups. For jour\u00adneys within Vienna accor\u00adding to the taxi\u00adme\u00adter, out\u00adside Vienna at a flat rate and all cou\u00adrier jour\u00adneys, the char\u00adge is made per quar\u00adter of an hour or part the\u00adreof, wher\u00adeby the first 5 minu\u00adtes of wai\u00adting time are included in the pri\u00adce. For pick-ups from the air\u00adport, the included wai\u00adting time is 30 minu\u00adtes after the arri\u00adval time. In the event of delays or chan\u00adges to the flight sche\u00addu\u00adle at the time of pick-up, the cli\u00adent is not obli\u00adged to inform the con\u00adtrac\u00adtor. This pro\u00advi\u00adsi\u00adon also appli\u00ades to the use of other means of trans\u00adpor\u00adta\u00adti\u00adon. In addi\u00adti\u00adon, the con\u00adtrac\u00adtor reser\u00adves the right to can\u00adcel air\u00adport pick-ups if sub\u00adse\u00adquent orders can no lon\u00adger be ful\u00adfil\u00adled on time. The ser\u00advice shall then be dee\u00admed to have been pro\u00advi\u00added and the cli\u00adent shall be invoi\u00adced in full. <\/p>\n\n
Cancellation of an order by the Client shall only be effec\u00adti\u00adve if it is made in wri\u00adting or, in the case of an oral decla\u00adra\u00adti\u00adon, is sub\u00adse\u00adquent\u00adly con\u00adfirm\u00aded in wri\u00adting by the Contractor. The time\u00adline\u00adss of the writ\u00adten can\u00adcel\u00adla\u00adti\u00adon is deter\u00admi\u00adned by the time of receipt by the con\u00adtrac\u00adtor. Cancellation shall be free of char\u00adge if it is made up to 24 hours befo\u00adre the agreed start of the jour\u00adney. Otherwise, the cli\u00adent will be char\u00adged a pro\u00adpor\u00adti\u00adon of the basic pri\u00adce of the jour\u00adney as com\u00adpen\u00adsa\u00adti\u00adon, pro\u00advi\u00added that the can\u00adcel\u00adla\u00adti\u00adon is the respon\u00adsi\u00adbi\u00adli\u00adty of the cli\u00adent and the con\u00adtrac\u00adtor is not respon\u00adsi\u00adble for it; up to 12 hours befo\u00adre the plan\u00adned start of the jour\u00adney, 50% will be char\u00adged. up to 3 hours befo\u00adre the plan\u00adned start of the jour\u00adney, 80% will be char\u00adged. in the case of later can\u00adcel\u00adla\u00adti\u00adons or fail\u00adure to start the jour\u00adney, 100% will be char\u00adged. In addi\u00adti\u00adon, the con\u00adtrac\u00adtor reser\u00adves the right to with\u00addraw from the con\u00adtract in part or in full if the cli\u00adent sus\u00adpends pay\u00adment, beco\u00admes insol\u00advent or it can be assu\u00admed due to other exter\u00adnal cir\u00adcum\u00ads\u00adtances that the ser\u00advice is being misu\u00ads\u00aded. <\/p>\n\n
Payment for the ser\u00advices ren\u00adde\u00adred incl. The pay\u00adment of any cash expen\u00adses incur\u00adred, of which the cli\u00adent must be infor\u00admed pri\u00ador to con\u00adclu\u00adsi\u00adon of the con\u00adtract, is due imme\u00addia\u00adte\u00adly upon issue of the invoice; a pay\u00adment term of 14 days is gran\u00adted. Timeliness of pay\u00adment shall be deter\u00admi\u00adned by the time of receipt of pay\u00adment into the Contractor\u2019s account. Any pay\u00adment will be used to sett\u00adle the oldest out\u00adstan\u00adding cla\u00adim. In the event of late pay\u00adment by the cli\u00adent, inte\u00adrest on arre\u00adars shall be char\u00adged at a rate of 5% abo\u00adve the prime rate. In addi\u00adti\u00adon, the cli\u00adent is obli\u00adged to bear all fees, expen\u00adses and other cos\u00adts incur\u00adred in the cour\u00adse of debt coll\u00adec\u00adtion.<\/p>\n\n
All legal rela\u00adti\u00adonships bet\u00adween Taxi Grill and its cus\u00adto\u00admers shall be gover\u00adned exclu\u00adsi\u00adve\u00adly by Austrian law; the place of juris\u00addic\u00adtion and place of per\u00adfor\u00admance shall be Vienna. Should one or more of the abo\u00adve con\u00addi\u00adti\u00adons be inva\u00adlid, the remai\u00adning con\u00addi\u00adti\u00adons shall remain unaf\u00adfec\u00adted by the inva\u00adli\u00addi\u00adty. Invalid clau\u00adses shall be repla\u00adced by the sta\u00adtu\u00adto\u00adry pro\u00advi\u00adsi\u00adons.<\/p>\n\n
